Following a comprehensive needs assessment (including consultations with local/international stakeholders), BlueLaw International LLP (BLI) designed a two-year training and technical assistance project whose purpose is to reform Ukraine’s administrative law courts. BLI was the major implementing subcontractor for this MCC project and was responsible for several aspects of this program. BLI provided training and technical assistance to establish a system of administrative courts in all regions. This included providing information about comparable international experience, helping translate materials on the European Court for Human Rights case law (as it relates to administrative law issues), and training new judges. Additionally, BLI helped add IT equipment to courts and developing an integrated electronic network in the regions.

BlueLaw International’s portion of this USAID project involved country-wide public procurement reform and other cross-cutting issues (including support to media efforts) largely related to e-procurement, aimed at significantly reducing opportunities for corruption and making better use of public funds by professionalizing the Government procurement process. The three electronic procurement program goals are 1) reform of the public procurement process to improve transparency using information technology; 2) enhance the institutional accountability mechanisms to detect, deter, and punish corrupt practices associated with the procurement of Works, Goods and Services; and 3) strengthen capacity to exercise vigilant oversight over procuring entities to ensure greater transparency in the public procurement system.

BlueLaw was the largest implementing subcontractor on this large MCC-funded project headquartered in Jakarta. BlueLaw provided significant short-term expertise to the court reform component of this $24 million project. This component included responsibility for reform of the management of courts’ human resources (right-sizing, standardized position descriptions, transparent hiring and evaluation criteria), judicial ethics training (for all judges and Supreme Court staff), conflict-of-interest training (wealth reporting), budget and finance issues (budget-based strategic planning, budget preparation, budget advocacy), publishing court decisions online, developing a uniform public complaint system, and court media training.

Streamlining the ability of the courts to process cases is critical to providing society with appropriate assurances that disputes will be adjudicated in a timely, efficient and predictable manner. By automating various court functions, In-ACCE enhanced model court efficiency and service. BlueLaw provided the co-team lead for this component, Ralph DeLoach. BLI also provided extensive short term technical assistance. Working closely with the model courts, In-ACCE achieved these outcomes through various targeted activities and interventions, including application of modern court administration practices, introduction of court automation and streamlined case processing, promotion of standardized recordkeeping, forms and court practices, provision of training and education programs, and pursuit of legal reforms designed to meet the objectives of the Blueprints and emerging international standards.

MCC Combating Informality

The objectives of this MCC Threshold program, implemented by USAID and the Treasury Department with implementation advice from DoD Military Group, were to provide commodity procurement and management support to Paraguay’s Threshold Country Plan (TCP) and to support the Government of Paraguay (GoP) meet the Millennium Challenge Corporation’s indicators—Ruling Justly and Economic Freedom. The project addressed the ability of government agencies to respond to the needs of the private sector, including efforts to decrease corruption within the public sector; institution building among GoP agencies and the civilian sector; improve government effectiveness; promote rule of law; and create an enabling environment for formal economic activities. BlueLaw worked directly with the GoP Attorney General, Department of Customs, National Police, and Navy providing effective training, border control processes and strategy, resulting in each beneficiary agency synchronizing their operations to effectively counteract illegal commerce across Paraguay’s porous borders.
